Welcome to Fortezza Trading (“Company”).
These Terms of Use (“Terms”) govern your access to and use of our website, evaluation programs, simulated trading platforms, funded accounts, and any related products or services (“Services”).

By accessing or using our Services, you agree to these Terms.
If you do not agree, do not use the Services.

1. Eligibility

By using our Services, you confirm that:

  1. You are at least 18 years old

  2. You are a resident of the United States

  3. You will only use the Services for lawful purposes

  4. You will provide accurate and truthful information

  5. You will not engage in fraudulent, deceptive, or manipulative conduct

If you falsify information or violate these conditions, your account may be terminated without refund.

2. Nature of the Services

Fortezza Trading provides:

  • Simulated trading evaluations

  • Performance assessments

  • Risk management tools

  • Educational and training resources

2.1 No Live Trading During Evaluation

All evaluations are 100% simulated.
No real funds are traded during the evaluation phase.

2.2 Evaluation Success is Not a Guarantee of Funding

Passing an evaluation may qualify a participant for a separate funded program, subject to:

  • Additional agreements

  • Identity verification

  • Risk review

  • Company approval

The Company reserves the right to deny funding for any reason.

2.3 We Are Not a Broker or Financial Advisor

Fortezza Trading:

  • Does not provide investment advice

  • Does not execute trades in financial markets

  • Does not act as a broker-dealer, introducing broker, or futures commission merchant

All trading during evaluations occurs in a simulated environment.

3. Account Registration

You must create an account to use certain Services.
You agree to:

  • Provide accurate information

  • Maintain confidentiality of your login credentials

  • Not share your account with others

  • Notify us immediately of unauthorized access

You are responsible for all activity under your account.

4. Evaluation Rules & Trading Conduct

By purchasing an evaluation, you agree to comply with all posted or provided rules, including but not limited to:

  • Daily loss limits

  • Maximum drawdown

  • Position size limits

  • Product restrictions

  • News event restrictions

  • Time-of-day trading restrictions

  • Platform-specific limitations

Violation of rules may result in immediate evaluation termination without refund.

5. Prohibited Activities

You agree NOT to:

5.1 Manipulate or Game the System

Examples include:

  • Latency arbitrage

  • Tick or data-feed manipulation

  • Use of disallowed bots or algorithms

  • Glitch exploitation

  • Platform abuse

  • Coordinated trading to influence simulated fills

5.2 Misrepresentation

  • Fake identities

  • Incorrect location or residency information

  • Multiple accounts for exploitative purposes

5.3 Attempt to Breach Security

  • Hacking

  • Reverse engineering

  • Circumventing protections

  • Unauthorized data access

6. Fees and Payment

Fees for evaluations and services:

  • Are posted on the website

  • Are non-refundable unless explicitly stated otherwise

  • May be subscription-based or one-time fees depending on the product

  • Must be paid prior to accessing the Evaluation

Chargebacks or payment disputes may result in account termination.

7. Technology, Platforms & Data Providers

We utilize third-party systems such as Rithmic and others.

We are not responsible for:

  • Platform downtime

  • System glitches

  • Internet connectivity issues

  • Delays in data transmission

  • Errors in price feeds

  • Execution discrepancies in simulated trading

These issues do not invalidate Evaluation results.

8. Intellectual Property

All content, branding, logos, software, and materials on our website and platforms are the property of Fortezza Trading or its licensors.

You may not:

  • Copy

  • Reproduce

  • Sell

  • Distribute

  • Reverse engineer

  • Misuse any intellectual property

9. Termination

We may suspend or terminate your account at any time for:

  • Violation of these Terms

  • Trading rule violations

  • Suspicion of fraud

  • Misuse of Services

  • Abusive behavior

  • Chargebacks or payment disputes

All fees paid are forfeited upon termination.

10. No Guarantee of Profit or Success

Trading involves substantial risk.
Past performance does not guarantee future results.

Fortezza Trading does not guarantee:

  • That any participant will pass an evaluation

  • That any participant will receive a funded account

  • That any participant will earn income

  • That any trading strategy will be profitable

You may lose your evaluation access without refund for violating rules.

11. Limitation of Liability

To the fullest extent permitted by law:

  • Fortezza Trading is not liable for any losses, including financial losses, lost profits, or damages arising from the use of our Services.

  • Our total liability to you will never exceed the amount paid for your most recent Evaluation.

  • All use of our Services is at your own risk.

12. Indemnification

You agree to indemnify and hold Fortezza Trading harmless from any claims, damages, or losses arising from:

  • Your use of the Services

  • Your violation of Terms

  • Your trading activity

  • Your misuse of third-party platforms

13. Governing Law

These Terms shall be governed by and interpreted according to the laws of:

The State of Florida, United States

Any disputes shall be resolved in Florida courts unless otherwise required by law.

14. Modifications to These Terms

We may update or modify these Terms at any time.
Changes take effect immediately upon posting.
Continued use of the Services constitutes acceptance of updated Terms.
